RS 32800 printed after sponsor revises bill to address governor's veto points on medical-intervention mandates

Senator Dan Foreman of District 6 presented RS 32800, a rewrite of a previously vetoed Senate bill. Foreman said he collaborated with the governor's staff and incorporated changes the governor requested. "That Senate bill was recently vetoed, so I reached out to the gentleman on the Second Floor and we've had some lengthy discussions with his staff and we've incorporated some of the changes," Foreman told the committee.
Foreman outlined specific adjustments in the RS. He said the draft separates private daycare facilities from the definition of "business entities" so daycare facilities retain protections in Idaho Code 39-11-18. The RS also tightens the statutory language by adding the word "medical" in front of "procedure" and "action" in the definition of medical intervention. Foreman said the RS references the Idaho Parental Rights Act and applicable school vaccine policy code sections to reassure members the changes do not alter existing parental-rights or school vaccine protections. "So, we're not changing anything, we just put that in there for reassurance and clarification," Foreman said.
Foreman also noted the bill swaps the term "employers" for "business entity" in places to clarify the scope of covered entities, distinguishing employees from patrons. He asked the committee to print the RS. Senator Ricks moved to send RS 32800 to print and another senator seconded the motion; the motion was approved by voice vote after Senator Wintrow said she would vote no because she previously opposed the original bill and was unconvinced the changes addressed her concerns. Foreman said the rewrite included the governor's requested clarifications and the RS will be printed for further consideration.
The transcript records that the RS incorporates statutory citations the sponsor cited: references to Idaho Code 39-11-18 (daycare protections) and the Idaho Parental Rights Act, "Idaho code 32-10-10 through 32-10-15." The sponsor also said references to school vaccine policy code sections were added "for reassurance and clarification." The committee approved printing RS 32800; the chair announced the motion carried and the RS will be sent to print.
