The conservation commission voted to accept a request for a minor amendment to DEP 128-1747 for work at 57 Old Spencer Road, approving an administrative allowance for an additional leach trench because the work is within an already-disturbed area and outside the 50-foot buffer.
A conservation staff member explained that the applicant initially filed a request for a determination of applicability (RDA) not realizing the earlier order of conditions remained on file and could be revived under COVID permit-extension provisions. The staff member told the commission, "The applicant is proposing an additional trench within an approved septic system. The work is within an already disturbed area and is outside the 50 foot buffer."
The staff member recommended an administrative approval rather than requiring a full new permit. Commissioners moved and seconded the recommendation; the commission voted in favor and accepted the request for a minor amendment.
The applicant was asked to provide the plan and the commission closed that agenda item after the vote.
