Committee advances Teacher and Student Protection Act to define violent behavior and authorize removals

Representative Scott Richardson presented House Bill 10-62, titled the Teacher and Student Protection Act, after constituent reports of classroom assaults. The bill defines "violent behavior" to include threatening language, throwing items that could cause harm, and physical abuse, and it adds violent behavior as a statutory reason warranting removal of a student from class.

The bill requires that, when a student is removed for violent behavior, the school perform a behavioral threat assessment to determine appropriate interventions. Richardson said the bill clarifies when a student can be placed in an "appropriate interim learning environment"—for example, an in-school suspension location that provides comparable instruction—and adds statutory clarity so teachers and districts have a defined process.

Committee members approved the bill on a voice vote after brief discussion. The sponsor said the language fills a gap in current code and aims to protect staff and students while maintaining access to equivalent instruction during interim placements.
