Commission approves vacation and abandonment of interior rights-of-way in El Mirador subdivision

The Taos County Commission held a public hearing and approved Resolution 2025-19 to vacate and abandon certain interior rights-of-way within the El Mirador subdivision to clarify maintenance responsibilities.
County planning staff explained the 1996 subdivision approval accepted dedication of rights-of-way but did not concurrently accept maintenance responsibility, creating a long-standing ambiguity. The resolution removes the county’s recorded dedication of the interior roads so that the homeowners association or road maintenance association can continue to maintain those roads without seeking county approval for changes such as signage or widening.
A representative of the El Mirador Property Owners Association, Ron Vander, told commissioners the association maintains the road and sought authority to post speed and no-trespassing signs and to avoid county liability for routine maintenance. Commissioners discussed related Upper Valley road-record issues and the need to finalize decisions for other subdivisions; staff said documents for some older plats were not recorded in the clerk’s office and additional follow-up is required.
Following the public comment, commissioners closed the hearing, moved to approve Resolution 2025-19 and adopted the vacation and abandonment motion by roll call.
