Commission approves updated HIPAA fee schedule for records requests

The Taos County Board of Commissioners approved a resolution to replace and refile the county’s records-request (HIPAA) fee schedule, moving to a structure modeled on the City of Albuquerque’s fees.
County records staff said the volume and complexity of records requests has increased and carries legal and financial implications. The proposed schedule will allow charges for actual costs associated with downloading electronic records to media or transmitting by mail and will include a modest per-hour charge for staff time to prepare records.
Records staff explained the implementation: requesters will enter time estimates in the county’s next records portal; the county will charge for staff time using a set hourly rate and proportionate billing for tasks such as downloading and redaction work. Commissioners asked whether staff time is billable; records staff said yes and described an example practice of charging an hourly rate and dividing it for shorter tasks.
Commissioners moved and seconded the resolution and approved it on a roll-call vote.
