Judge Boyd delays decision on occupational license for John Philip McCarter pending proof of insurance and schedules May hearing

Judge Stephanie Boyd delayed consideration of an occupational-license petition for John Philip McCarter and reset the matter for May 5, instructing defense to supply proof of full insurance and vehicle details before the next hearing.

At the docket the defense said McCarter had completed intervention classes and other conditions and requested an occupational license for travel to work and to transport his home-schooled child. Judge Boyd told counsel she needed a copy of McCarter's insurance and proof whether it was liability-only or full insurance and asked about the vehicles available to the defendant. "So this is what the court is going to want. I'm going to want a copy of, you know, his insurance, proof of insurance... If I am going to approve it, I'm not gonna approve it till after April. And the reason being, we have something coming up in this town in April known as Fiesta. And, I'm doing that to make sure that the community is protected," the judge said on the record.

The court asked defense to file or supplement the petition with insurance documentation and scheduled the matter for May 5 so the court could proceed after community events in April. The judge indicated the order would follow receipt of the insurance proof and that the parties could staple or supplement the e-filed petition with the requested documents.
