Haysville planning panel tables public hearing on proposed wireless tower

The Haysville City Planning Commission on an unspecified meeting date opened and then tabled a public hearing on a conditional use permit to build a new wireless communication tower at the corner of West Street and 70 Ninth Street after staff said new information had emerged that day.
The commission chair opened the hearing and said, “The Kansas Supreme Court has defined the role of the planning commission as a quasi judicial function to protect the rights of all parties involved and in order to create an opportunity for everyone to speak their opinions and present information to assist the planning commission in reaching a decision.” The chair also noted that the fact-finding procedure materials were available near the hearing room door.
During disclosures, one commissioner reported having been contacted by a resident about the case. The commissioner said, “Greg Finster, who lives on 70 Ninth Street, talked to me about it. And I just have some concerns and you want me to say what those concerns were? No.” The staff report included the written materials submitted to the commission; staff also told the commission it had received no additional written or electronic communications beyond what was in that report.
A staff member then said, “So in light of the information that was brought to staff today, I'm requesting that we table this item for further staff consideration and move it to our next scheduled meeting, February 27.” A motion to table the public hearing to the Feb. 27 meeting was made, seconded and approved by the commission.
Earlier in the meeting the commission approved the minutes from its Jan. 23, 2025, meeting. There was no old business or correspondence off the agenda reported, and the commission set its next meeting for Feb. 27.
The tabling means the commission will not take a final vote on the conditional use permit at this meeting; staff said it needs additional time to consider newly received information before resuming the hearing on Feb. 27.
