Cowlitz County commissioners received a report from county representatives who attended a risk-pool conference outlining statewide concerns about recent changes to civil claims for sexual-assault cases and related insurance impacts.
A county representative summarized presentations at the conference, citing California—s experience after removing the statute of limitations for sexual-assault claims. The speaker said conference presenters had projected an $800 million increase in claims in California but that actual claims have grown to $3 billion. The county representative said conference attendees warned of a likely substantial increase in claims and claim sizes in Washington.
County staff said the risk pool is projecting a 25% across-the-board premium increase to start, tied to both claim frequency and larger settlement sizes. Staff described specific drivers: (1) an anticipated surge of historical claims after removal of the statute of limitations, (2) national law-firm advertising that solicits historic claimants, and (3) an increase in the number and size of insurer participants being restricted, which is pushing counties to purchase coverage from more insurers with narrower slices of risk.
The county representative also reported operational practices discussed at the conference for reducing jail-related claims, including inmate-health monitoring (wearable scanners) and other mitigation practices. Staff noted that jail claims currently represent a large portion of liability exposures and that counties are exploring ways to limit claims.
The briefing flagged uncertainty about how large reserves counties will need. The county representative said the risk pool does not yet know how much capital will be required for future liabilities and that some counties are no longer able to self-insure due to rising claim volumes and sizes.
The commissioners did not take formal action on policy at the meeting. Staff said they and other county leaders will continue to monitor risk-pool developments and pursue mitigation strategies.
