Adrianne Walker told the board the enclosure had been constructed without a permit or ARB approval and was subject to a stop‑work order; the applicant is Bavari Pensacola, a restaurant on Palafox. Pedro Adamas, representing Bavaria, said the unpermitted enclosure was intended to screen an unsightly cooler and mechanical equipment from the public courtyard and to improve aesthetics for an outdoor seating area. The applicant described a “faux German cottage” motif and said the final finish would be toned down from the inspiration image.
Staff and board members advised that because the structure sits within 3 feet of the property line in places, fire‑rating and building‑permit issues must be resolved with the building department. The board discussed whether to grant conceptual approval while the building‑permit issues are addressed. After discussion, members moved to approve the application on condition that the applicant submit final exterior elevations for abbreviated review and resolve any building‑department requirements prior to permit issuance.
The motion passed by voice vote. Staff said the applicant must seek a building permit (which will require ARB approval to be uploaded with the permit application) and that staff will coordinate with the building department to expedite the review and to resolve fire‑rating matters before final permitting.
