The Village of Tuckahoe Zoning Board of Appeals voted to grant area variances for an addition at 91 Summit Avenue during its March 12, 2025 meeting. The board also adopted a SEQR negative declaration, determining the project would not have a significant adverse environmental impact.
The variances were requested to allow a new addition that would sit 11.51 feet from the side yard, which does not meet the numeric side-yard requirement in the village zoning code. The board said the benefit to the applicant outweighed any detriment to neighborhood health, safety and welfare and that the application satisfied the board’s five-pronged variance test.
Applicant David Fayer of 91 Summit Avenue presented the request; the board reviewed the submitted materials and public comment was none. The board’s approval includes a condition that work under the granted variance must be commenced and diligently prosecuted within one year of the approval, or the variance will become null and void.
Chairwoman Brown; Member Peoria; and Member Rinaldi indicated their support during the roll call. The board first considered and adopted a SEQR negative declaration before approving the variances.
The board record states the approval is contingent on the condition above; no additional permits, inspections, or further conditions were specified in the meeting transcript. Any required building permits or inspections will be administered by the Village of Tuckahoe building department.
