House committee approves amended reimbursement plan after discussion of Lake County withdrawal from PL‑280 and CSKT funding

Representative Sharp moved an amendment to House Bill 366 that added two new sections clarifying permissible uses of the appropriation in the bill, recognized that Lake County had withdrawn from Public Law 280, and redirected the appropriation to the Office of Budget and Program Planning for distribution in equal shares to Lake County and the Confederated Salish and Kootenai Tribes (CSKT). The amendment also lowered the appropriation amount and added a severability clause.
Sponsor Representative Sharp and several committee members described a long history of Public Law 280 implementation in Lake County, discussed prior legislation (House Bill 656) and a veto in a prior session, and said the amendment was designed to provide the tribe and county transitional assistance while recognizing the county’s asserted withdrawal from PL‑280. Vice Chair France and others raised procedural and policy questions about working with the Senate bill that addresses similar issues.
The committee adopted Amendment HB0366.001.005 on a roll call vote of 14 yes and 6 no and then passed House Bill 366 as amended by roll call, 14 yes and 6 no. The bill was recorded as passed out of the House Judiciary Committee.
