Committee approves sale of air rights to Bedrock for building over Scranton (Eagle) Avenue

The Municipal Services and Properties Committee on March 31 approved an emergency ordinance authorizing the mayor’s office of capital projects to sell city-owned air rights over the Scranton Road (Eagle Avenue) right of way to Bedrock for construction of the Cleveland Clinic Global Performance Center.
Director remarks and staff slides described the project as part of the Bedrock development that will have a portion of the building straddle the right of way. City staff said Bedrock’s surveyors created a discrete air-rights parcel for the portion of the building that extends above the public right of way. The ordinance authorizes sale of that parcel to Bedrock for $120,000 and authorizes an agreement for construction, operation, maintenance, inspection and repair of the overhead structure; staff said the city will retain inspection authority and require maintenance similar to bridge inspections because the structure will be over a public right of way.
Committee members were shown maps and renderings in the meeting packet, and no substantive amendment was raised during the discussion. The ordinance passed by voice vote.
Staff said maps and renderings were sent to council members’ tablets; the committee chair asked members to sign the approved ordinance.
