Representatives for Farmington Electric Utility System presented the recommendation to council. Mr. Ritter (presenter) and Mr. Adair described the city utility’s recommendation and said approval is contingent on completing negotiations and securing amended agreements with the New Mexico Economic Development Department.
Councilor Giacchino moved to approve the execution of the asset purchase-and-sale agreement and the EPC agreement between the city and Luth Cowan Renewables LLC; the motion was seconded and approved by unanimous voice vote.
City staff recorded the contingency twice in public remarks: the agreements are subject to final negotiation and to the state economic development department executing amended agreements.
