Council approves Code & Regulation committee recommendations; denies needle-exchange special use permit

The Rockford City Council on March 17 approved four items forwarded by the Code & Regulation Committee and recorded votes on each item.

Alderman Trina read four committee recommendations: authorization to place city-owned property at 727 South Third Street for sale; approval of the final plat for the Capra Subdivision; sustaining the Zoning Board of Appeals' recommendation to deny a special use permit for a needle-exchange at 401 West State Street, Suite 200 (C-4 urban mixed-use zoning); and approval of an Illinois EPA Highway Authority Agreement addendum for property at 3005 North Watson Avenue. The clerk recorded roll-call votes: items 1 and 2 passed with 10 ayes; item 3 (needle exchange denial) passed 9 ayes, 1 no; item 4 passed with 10 ayes. The legal director will prepare the appropriate ordinances where required.

During committee reports, the Zoning Board and Liquor & Tobacco Advisory Board agendas and an authorization to allow the zoning officer to file a text amendment regarding electric vehicle charging stations were referred to committee. In new business the council also approved an ordinance authorizing eminent domain acquisitions of approximately 519 and 680 square feet from two parcels to complete pedestrian access improvements for a West State Street sidewalk gap project; the council suspended Rule 9 to consider that ordinance on first reading and approved it by roll call.

Alderman questions during the new-business discussion clarified that the IEPA agreement was tied to Brownfields work and remediation activity: staff explained the agreement would place a notification on file and that the property had been subject to fuel-tank contamination and remediation steps designed to meet IEPA residential-tier standards.

The denial of the needle-exchange special use permit was a sustaining of the zoning board's prior recommendation; council recorded one "no" vote on that item in the clerk's tally.
