Resident asks how city law director can prosecute misdemeanors countywide; law director cites Ohio Revised Code 1901.34

During the public‑comment portion of the meeting, Timothy Daniel of 20779 Justice Road, Williamsport, asked the Circleville City Council whether the city law director’s authority to prosecute misdemeanor offenses extends across Pickaway County and where that authority comes from.

“Where does the authority for the city law director come from to prosecute misdemeanor crimes across the county?” Daniel asked. He said he had sought answers from judges, court clerks and the board of elections and had not received a definitive response.

Kendra, the city law director, spoke to Daniel’s question. “Pursuant to Ohio Revised Code section 1901.34, the city law director or, if villages or cities have solicitors, is charged with… pursuant to Ohio Revised Code,” she said, adding that the county commissioners also have the record of that statute. Council President Keller advised Daniel to set up an appointment with the law director’s office for further discussion.

Why this matters: The question raised who may exercise prosecutorial functions in municipal and county courts and whether an elected municipal law director’s duties extend beyond city boundaries. The law director cited a specific Ohio Revised Code provision as the source of authority during her remarks, but Daniel said he had not received a written or definitive response from prior inquiries.
