The Dayton City Council approved a code amendment Feb. 11 that removes an older provision requiring refuse containers to be stored at the rear of the property and consolidates container-location rules in a single chapter. The amendment also updates the maximum container size to match common service-provider sizes and requires dumpsters at construction sites to be covered at the end of the day to prevent debris escaping into the neighborhood.
Staff said the update resolves a conflict between a 1978 chapter that mandated rear-yard storage and a more recent chapter that required containers to be kept "neat and orderly" and within three feet of the dwelling; the new language consolidates location and appearance standards in the more recent chapter and replaces the obsolete rear-yard requirement. Staff also recommended changing the numeric size limit to reflect standard provider containers.
Council members discussed enforcement mechanisms, permitting for temporary dumpsters during remodels, and how to tailor language to allow short-term construction containers while preventing long-term front-yard dumpsters on single-family properties. The council approved the amendment 5-0.
