The Dayton Planning Commission voted 4-0 on Feb. 6 to approve a conditional-use permit allowing construction of a 52-by-36-foot accessory structure at 17901 140th Avenue North that will increase the parcel's impervious surface from about 14.8% to roughly 20.1%. The property lies in the city's A-1 agricultural district, where the code limits impervious surface to 10% without a conditional-use permit.
Staff told commissioners the site is a legal nonconforming lot (about 0.2 acres) and that, although the lot currently exceeds the 10% threshold, the permit was required to authorize the additional increase. A staff presentation noted the lot lacks city sewer and water and that city review focused on setbacks, setback distance from the septic field and space for a secondary septic site.
The permit was approved with conditions. The planned conditions require the applicant to submit a site plan showing an alternate septic location and proof that the proposed structure will not burden the septic system before a building permit is issued. The decision also prevents any additional accessory structures on the parcel and makes any future additional impervious surface contingent on an amendment to the conditional-use permit.
Applicant Carrie Curran told the commission the structure would be "whole building just for personal use, bulk storage. It will be not used for any business or rent or anything like that. It's just for my personal. I've got motor homes, boats, trailers," and said neighbors currently let her keep vehicles on their property temporarily.
Commissioners who spoke in discussion said the lot is unusually small for the A-1 district and that the request appears reasonable given the lot's constraints. Commissioners also asked staff to spell out the findings and to reflect screening decisions in the council resolution so future reviewers can see why staff concluded no additional screening was necessary.
The commission recorded the action as: motion to approve staff's proposed resolution with the conditions described; tally: 4 yes, 0 no. The file will move to city council for final action and for incorporation of the commission's recommended findings into the resolution.
Notes: The commission record says the site currently has about 14.8% impervious coverage and with the accessory building would reach approximately 20.1%; the conforming lot size in A-1 is 40 acres, so the applicant's lot is treated as legal nonconforming.
