Rep. John Weber, a state representative for District 34, introduced RS32550, a proposed rule to shift governance of homeowners associations (HOAs) from developers to homeowners once a community reaches a specified buildout threshold.
Weber said the measure “starts a sudden transition from builders to the homeowners, and give them the homeowners a seat on the at the table, when it comes to, HOA boards. And then after 95% of the build out that they start transition full control to the homeowners. With that, mister chairman, that's the main gist of this bill.”
The measure, which Weber said Representative Monks helped restart this session, would require the declarant (the developer or entity that filed the declaration creating the association) to begin a transition process and complete turnover of full control to homeowners when 95% of the development is built out. The bill text, as described in committee, defines “declarant” in the declarations and association definitions.
Representative Tanner asked whether the bill applies to the declarant — “Is being the builder itself holding the land, like, holding the lots and control at that point?” Weber confirmed: “Yes. ... they'll remain in control, of the HOA until it hits that 95%.” Tanner later added a comment of support with a caveat: “I actually do like this bill, but I wish you'd have brought it down a little lower, maybe even like 60%. But it is a good 1.”
Representative Crane moved to introduce RS32550. Chairman Ehlers put the motion to a voice vote; committee members responded “aye” and the motion carried by voice vote. The committee did not record a roll-call tally in the transcript.
The introduction places RS32550 on the committee record for further consideration; committee members did not adopt policy changes at the meeting, only approved introduction and referral for later action.
