Committee introduces language to allow minors at historic theaters selling beer and wine

The House State Affairs Committee voted to introduce RS 32,467, a legislative request that would change licensing language to allow minors to attend movies at theaters located in buildings listed on the National Register of Historic Places when the theater holds a beer-and-wine license.
Representative Clough said the change responds to a Twin Falls theater that serves beer and wine but is prohibited from admitting minors because current language requires a building have been constructed originally as a theater to qualify. Clough said the RS “takes out some language that very simply says that if a movie theater has a beer and wine license and they are in an historic registered building, registered in the historic national register, that could sell beer and wine and allow minors to come to the movies too.”
Representative Akiles moved to introduce RS 32,467; the committee adopted the motion by voice vote and the chair declared the motion carried. Representative Clough said he would be glad to answer questions at a later hearing and sought only introductory action today.
The RS, as described in committee, would remove the statutory requirement that a building must have been built originally as a theater to qualify for the exception permitting minors when beer and wine are sold. Representative Clough characterized the change as narrowly targeted to permit historic registered buildings to qualify; the RS was introduced for further consideration rather than enacted at this meeting.
