Commission recommends modifying state land stipulations for Z00-158.1 to align with current code

The Planning and Zoning Commission voted 4-0 to recommend that City Council approve modifications to conditions of approval for a state-land parcel (case Z00-158.1) so future applications on the property will be reviewed under current Peoria code and overlays.
The Peoria Planning and Zoning Commission on March 6 voted unanimously to forward a positive recommendation to City Council for a stipulation modification to case Z00-158.1, a city-led request in collaboration with the State Land Department to update conditions attached to an earlier rezoning.
Deputy Director Lori Deaver told commissioners the request applies to roughly 720 gross acres north of Dixaletta Road and west of Lake Pleasant Park and seeks to replace ambiguous, unnecessary or antiquated conditions from the original ordinance with references to the city’s updated code and current regulatory processes. "Most of the conditions that you see are either ambiguous, unnecessary, or antiquated," Deaver said, adding that aligning the parcel with modern overlays and standards will "level the playing field" for future applicants.
Deaver said the existing ordinance and its stipulations date back decades; since that time the city has adopted new tools such as the Hillside Development overlay and the Desert Lands Conservation overlay and refined landscaping and other development standards. She said the change is intended to make review processes consistent with other properties along Loop 303 and to rely on contemporary regulations rather than unique historic stipulations.
Commissioners asked whether the city is working with the State Land Department. Deaver confirmed the city is collaborating with State Land and that this parcel is one of the few in the area that already carries zoning. Commissioner Cottrell asked whether this change would later fold into a larger rezoning effort the city described as a "Pure Innovation Core" rezoning for roughly 6,700 acres north of Pleasant Valley; staff said that is the intention and that the larger effort will proceed on a longer timeline.
There were no public speakers on the item. Commissioner Fighter made the motion to approve the stipulation modification (case Z00-158.1) and the motion was seconded; the commission voted 4-0 to forward a positive recommendation to City Council.
Staff recommended approval subject to the modified conditions of approval presented in the staff packet; the item will return to City Council for final action.
