The council discussed a proposed land exchange offer and potential purchase of a site for a future water well in Falls County during the March 27 meeting and voted to table final action so the city attorney could review the complex deed language and the parties could finalize terms.
Staff described revised terms negotiated with the landowner: an acre of property to be sold to the city with access (either to Highway 7 or via Doody Park), a one‑acre gift by the owner (a life‑estate/"ladybird" deed was noted), provision of up to eight water meters (two for each heir) with a 10‑year shelf life, and a proposed city payment of $20,000. MRB Group had evaluated three candidate sites and recommended the site closest to Doody Park based on hydrologic and geologic conditions; staff noted potential floodplain concerns and the need to build the site above a nearby dry creek pending Falls County floodplain mapping.
Because the ownership title uses an enhanced life‑estate deed (a recent discovery), the council directed staff to order a survey to confirm boundaries and tabled the purchase pending review by the city attorney. Councilors voted to authorize the survey and to defer the purchase until the attorney provides legal guidance on the deed transfer and easement language needed for access and utility connections.
