The amendment — presented as Amendment No. 8 by Representative James Zimmerman — removes a preclusion on county zoning authorities that would have extended to single-wide manufactured homes and restores a formulation that prevents counties from precluding double-wide manufactured housing while leaving regulation of single-wide siting to counties.
Representative Zimmerman said the change was "just a restatement of current law" and that the language was agreed with the Indiana Association of Counties and the manufactured-housing industry. Senator Schmidt asked whether the amendment changed width or size thresholds; Zimmerman and supporters characterized the amendment as returning the statute to the status quo and said it had been negotiated with counties.
Committee members from counties confirmed the amendment's practical effect. One senator noted that La Porte County has local ordinances governing single-wide units and that the amendment preserves local authority to require variances, special uses or other local processes for single-wide manufactured homes.
The amendment was moved, seconded and adopted by consent; the committee then approved the amended bill by roll call with the committee chair recording the passage (10 yeas).
