Commission reviews revised state contract for Mud Creek boat ramp; raises maintenance and liability concerns

Jackson County commissioners reviewed a revised maintenance and security agreement offered by the Alabama Department of Conservation to cover multiple boat access sites, including a new Mud Creek North ramp, and discussed concerns about long-term county responsibilities.

Chairman Nance summarized the revised contract and said the agreement would make the county responsible for routine, day-to-day maintenance while the state would fund up to $50,000 per calendar year per access area for nonroutine, larger repairs. "It does not fund us for routine maintenance and repair that would be required," Nance said, and he added concern that the draft allows the state to terminate unilaterally but does not give the county a reciprocal exit right.

County Attorney Porter and other commissioners said the revision is an improvement over an earlier draft but remains one-sided. Porter described routine duties—mowing, trash pickup, lighting checks—as a "pretty heavy burden on the county" and noted the proposal could last 25 years with an option for the state to renew for another 25. Commissioners asked staff to compile comments and invite the state fisheries coordinator to discuss the agreement at a future meeting.

Commissioners also confirmed the state conveyed the new construction funding and that the proposed Mud Creek ramp responds to heavy local demand; they agreed to take time over the next weeks to provide formal comments to the state.
