The owner, Jose Roberto Rodriguez (who said he intends the dwelling for his mother), told commissioners the new unit has been placed on a foundation and has new siding, but that no permits or inspections had yet been completed; county code enforcement had halted work pending approval.
Staff outlined required steps to regularize the dwelling, including obtaining building permits and inspections; verifying or upgrading the septic system; and bringing the structure to the county’s minimum residential square footage. During discussion staff and board members indicated the unit must meet the county square footage threshold (discussion referenced a 1,100 square‑foot benchmark) and identified that the applicant would need to add roughly 400 square feet and complete inspections to reach compliance. Staff recommended approval conditional on completion of that path. Planning commission had recommended denial.
A motion to approve the special exception with the staff conditions carried 4‑1. Commissioners debated a proposal to add a condition forbidding future rental of the unit; after discussion the board did not impose an ongoing owner‑occupancy restriction but left the path to legalize the structure (permits, inspections, impact fee determination) in place. County staff noted replacement construction is not subject to development impact fees under the cited ordinance section.
