Council authorizes settlement actions and approves forensic-audit findings in executive session

After returning from an executive session on March 25, the City Council took two public actions that staff said flowed from confidential legal advice and an audit review.
Councilperson Foster moved to “direct legal counsel to finalize and execute the settlement agreement regarding proceedings in the Bastrop County Court at Law No. 1, cause numbers 20-20284 and 23-21970, City of Bastrop v. John A. and Tina T. Nixon.” Councilperson Plunkett seconded the motion; the council voted unanimously to direct legal counsel to complete and sign the settlement documents.
Later in the meeting the council considered item 4c and approved a motion from Councilperson Myers, seconded by Councilperson Lee, “to approve the findings as presented in the Vertex Company’s audit report regarding payment to KSA.” That motion also passed unanimously.
Why it matters: Both actions were taken after an executive session cited under Texas Government Code sections 551.071 and 551.072. The settlement direction authorizes counsel to finalize litigation resolution, and the audit-finding approval accepts staff’s summary of a forensic audit related to payments to an engineering firm; both items were recorded in public session as required following the closed meeting.
