Indian River Shores council bans marijuana dispensaries with unanimous vote

The Town of Indian River Shores council voted unanimously March 26, 2025, to adopt Ordinance No. 577, banning marijuana dispensary facilities in town and adding definitions for “marijuana” and “marijuana dispensary.”
The ordinance was read on the council floor by the town attorney and considered at a second reading before the vote. The motion to adopt passed on a roll-call vote with Mayor Foley and council members Atwater, Carroll, Alteri and Dane recorded as voting "Aye." After the vote, Mayor Foley said, "Henceforth, anybody who wants to sell pot in the town of Indian River Shores, you have a statute you have to comply with."
Town Attorney Sweeney read the ordinance title aloud as required for second reading: an ordinance banning marijuana dispensary facilities, adding definitions, providing for severability and scrivener's errors, repeal of conflicting ordinances, codification and an effective date. There was no public comment at the second reading, and council made no amendments prior to the vote.
The ordinance now becomes part of the town code as the council specified; the effective date was included in the ordinance text as read. The council did not identify any conditions or follow-up tasks attached to the adoption during the meeting.
Because the item passed on second reading, no further readings were announced at the meeting.
Votes at the March 26 meeting were recorded by roll call as unanimous. The town's official ordinance number is 577 and is now listed in the town's codified ordinances.
