Committee approves clarification protecting water rights placed in water bank from forfeiture timing

The House Resources and Conservation Committee voted to advance Senate Bill 1084 after Representative Raybould said the bill clarifies the effect of placing a water right in the water bank on forfeiture timelines.
“Essentially a clock starts ticking based on when you use or don't use said water right,” Raybould said. Under current law, he said, the forfeiture delay applies only when a right placed in the bank is actively leased; the bill would ensure that rights held in the bank are not penalized later when their owner seeks to withdraw them.
Raybould described the measure as treating water rights “equivalently when they come out of the water bank regardless of whether or not they were leased or did nothing while they sat in the bank.” Representative Gerald Raymond moved to send SB 1084 to the floor with a due-pass recommendation; the committee approved the motion by voice vote.
