Plan commission holds Colonial Woods 16‑unit proposal after homeowners object to rentals and unfinished work

The Oak Creek Plan Commission voted to hold consideration of site and architectural plans for a proposed 16‑unit building in the Colonial Woods development until May 20, 2025, after extended public comment and questions about homeowner notification, private‑road maintenance and whether the units would be rentals rather than condominium units.
Department of Community Development staff member Todd presented the plan review, saying the proposal follows a plan unit development (PUD) and the building’s architecture matches prior approvals. Chris Hall, an architect for the applicant, and Sam Swan, the project construction manager, were present; HomePath Financial, the property owner listed on the application, did not appear.
Multiple residents and association representatives told the commission they learned of the project only when the agenda published the prior week. Amy Peterselli, attorney for the Colonial Woods Homeowners Association, told the commission, "the board and the unit owners heard of this entire issue was last week," and asked that the item be tabled to allow negotiation with the owner. Several homeowners said HomePath had not responded to requests, that parts of the private cul‑de‑sac road remained unfinished and that the association’s declaration contains restrictions on rental percentage that they believe apply to the site.
Commissioners expressed concern about the lack of developer representation and the unresolved disputes between the HOA and the property owner. Commissioner Don said he could not support action without Hatch partner/owner responses; Commissioner Matt recommended a hold to give the parties time to consult with the city attorney and to provide the developer an opportunity to meet with stakeholders.
Commissioner Koskin moved to hold the item; Commissioner Steve Bauch seconded. The roll call recorded affirmative votes from Commissioner Buzakowski, Commissioner Oldani, Commissioner Stiefer, Commissioner Chandler and Chair Sullivan. The commission recorded the hold to May 20, 2025. The motion and discussion noted the application will return to the commission at that date unless the applicant withdraws or seeks another procedural path.
Commission staff said approval of a compliant site plan would allow the applicant to later apply for building permits, but the commission held the matter to let homeowners, the association and the property owner address outstanding legal and access questions.
