Council approves change order with Jokers Paving to repair failed retaining wall on North Mill Street (Bill 48-12)

The Festus City Council adopted Bill 48-12 to authorize a change order with Jokers Paving and Contracting for repair of a failed retaining wall in front of 119 North Mill Street as part of the North Mill Street improvements project.
Staff told the council the wall failed and is within the city right-of-way; replacing it requires tearing up adjacent sidewalk and street and is therefore proposed as a change order to the existing North Mill Street contract. "The retaining wall located in front of 119 North Mill Street has failed and is in need of repair," a staff member said, adding that including the repair as a change order avoids the longer MoDOT approval process that would be required if handled separately.
Council members asked about inspecting the adjacent house foundation and whether future liability would remain with the city. Staff said the city could pursue pre-construction inspection services to document existing conditions and confirmed the wall and right-of-way remain city responsibility after reconstruction. Staff also reported that water main and gas work in the corridor have been addressed, and Spire (gas) work would be finished before the North Mill project begins in April.
The council suspended rules, read Bill 48-12 on second reading and approved it by roll call. The ordinance authorizes the mayor to execute the change order and incorporates related contract documents into the ordinance.
