BSC Group, representing the North County Land Trust, asked the Gardner City Conservation Commission to correct clerical errors and to add a disclaimer page to the order of conditions for a gravel-pit stabilization project at the Ebenezer Keys conservation area.
Paul Martin of BSC Group said that the issued order of conditions contained items that did not match the approved plans — for example, a checked box indicating a pond or stream where none exists and conditions referencing practices (mulching) that do not reflect the agreed plan. Martin proposed a disclaimer page that would identify and document the inapplicable or clerical items rather than reopening the entire order of conditions.
Commissioners discussed options. One commissioner noted the commission had not previously amended orders to remove conditions and that reopening the order could be problematic. The group agreed the disclaimer approach would address the practical issues and maintain the record. Justin (city staff) said clerical corrections had already been made to the form fields. The commission asked BSC Group to assemble a disclaimer capturing the 15 items Martin flagged; staff will review and the matter was continued to April 14 for final review and signature.
Action taken: Commissioners voted to continue the Ebenezer Keys amendment request to April 14 and directed the applicant to submit a draft disclaimer and any corrected clerical entries for review prior to that meeting.
