Councilor Roby presented the Urban Affairs Committee recommendation to approve the special permit application from Marlborough Maple Real Estate Trust. The city clerk read a set of conditions attached to the approval: construction must comply with applicable state and local laws; the project is subject to detailed site‑plan review before a building permit; signage must conform to city rules; hours for the restaurant and drive‑through are capped at 5 a.m.–9 p.m.; no overnight parking is allowed; and deliveries by semi‑trailer are restricted to 7 a.m.–7 p.m. The permit also requires a pedestal speaker system that automatically adjusts to ambient noise and limits audio levels at the property line to levels permitted in residential zones.
The special permit incorporates submitted plans and renderings and requires the applicant to record the special‑permit decision in the Middlesex South registry of deeds after the 20‑day appeal period expires and before a building permit is issued. The council asked that any additional required engineering or plan changes be handled through the city site‑plan review process.
