Council approves third amendment to Rolling Prairie Phase 1 developer agreement increasing MRO and extending completion date

The Portage City Common Council voted to approve a third amendment to the Phase 1 developer agreement for the Rolling Prairie subdivision that increases the municipal revenue obligation and extends the developer completion deadline.

Planning and development staff described the amendment as cleanup and reimbursement for additional developer costs associated with moving a lift-station antenna and building a new antenna pole and concrete pad after a reused antenna failed site signaling tests. Staff said the added cost was $18,958 and asked the council to increase the MRO accordingly. The amendment also adjusts the completion date to March 1, 2025, with remaining minor demolition and asphalt work to be completed under the project’s warranty and secured by the developer’s letter of credit.

Staff said the developer’s letter of credit covers 25% of construction cost and that any remaining punch-list items are expected to be covered during the warranty period through March 2026. The staff recommendation was to approve the amendment.

Alderperson Green moved to approve the third amendment; Alderperson Wetzel seconded. A roll-call vote recorded unanimous support; the motion carried.

The amendment increases the MRO from $2,315,356.57 to $2,334,314.57, according to staff.
