Representative Tanya Burgoyne, R-Pocatello, presented House Bill 312 to the House Health and Welfare Committee. Burgoyne said the bill transfers 19 sections from IDAPA 16.06.03 (daycare licensing) into statute, covering definitions, licensing standards, safety standards, fees, training requirements, behavior management, and complaints.
Burgoyne framed HB312 as part of a broader initiative to move longstanding administrative provisions back under legislative control. "This proposed legislation seeks to move a long standing provision of administrative rules from the Department's control... back to the hands of the elected legislature," Burgoyne said. She added the chapter has been before the legislature previously, most recently in 2024.
Representative Kaler asked whether HB312 would conflict with House Bill 243; Burgoyne replied it would not. Burgoyne asked for a due-pass recommendation. The committee moved and approved sending HB312 to the floor with a due-pass recommendation by voice vote; the transcript records "Aye" and the chair declared the motion passed.
