Panel introduces RS 32,534 to adjust assisted-living monitoring language

BOISE — State Rep. Healy, R-West Boise, asked the House Health and Welfare Committee to introduce RS 32,534, a revision related to monitoring in assisted-living facilities that removes a portion of prior language delegating rulemaking authority to the Department of Health and Welfare.
Healy told the committee the RS is a follow-up to a previously filed draft and that one section he overlooked in the prior version — on page 3, lines 20 through 22 — granted rulemaking authority to the department. "To prevent us to be here in a year doing what we're doing and having those rules brought back into statute, we thought now would be a good time to just have that part taken out," he said.
Healy said the RS does not change other monitoring provisions and that the intent is to "get ahead of the game" so the Legislature need not revisit the matter next year. Representative Ekberg moved to introduce RS 32,534; the committee approved the motion by voice vote and the RS was introduced. No roll-call tally was taken during the introduction.
The sponsor framed the filing as a narrow amendment to a previously discussed RS; no public testimony or agency representatives spoke on the item during the meeting and no hearing date was announced.
