Committee introduces RS 32,491 to move child-support rule into statute

BOISE — State Rep. Lucas Kaler, R-Caldwell, asked the House Health and Welfare Committee on Thursday to introduce RS 32,491, legislation that would move an existing Department of Health and Welfare rule on child support services (IDAPA 16.03.00.03) into statute.
Kaler told the committee the measure would not create any new law. "No new laws were created," he said, describing the proposal as part of the agency director’s effort to clean up rule sections under the governor’s directive for zero-based regulation.
Kaler said the new RS is a revised version of an earlier draft, RS 32,391. The earlier draft included a section 7 that "stated that the Department shall deduct legal costs incurred by the Department up to a maximum of 20 for any collection," language Kaler said the agency later removed from its rule. He told the committee the language no longer applied and that the updated RS removes that provision (what had been section 8 in the earlier draft has been renumbered to section 7 in the current RS).
Representative Levitt moved to introduce RS 32,491; the committee approved the motion by voice vote and the RS was introduced. The committee did not record a roll-call tally; a verbal "Aye" was entered and no opposition was voiced.
The sponsor and committee characterized the filing as an administrative cleanup to align rule text with the agency's current practices. No hearing date or additional steps were specified during the meeting.
