Council approves rezoning at 3800 South Cherokee Drive for accessory dwelling and barn

The Muskogee City Council on March 20 approved Ordinance 4246A rezoning the property at 3800 South Cherokee Drive from R‑1, single‑family, to RA, agricultural‑residential, allowing construction of an accessory dwelling unit and an apiary barn.

Planning staffer Miss Winkle told the council the request conforms to the City of Muskogee 2013 comprehensive plan and that neighbors had been notified. “They are wanting to construct an accessory dwelling unit that is gonna be, and an apiary barn,” Winkle said during the public hearing.

The rezoning drew brief questions from council members about the barn and whether the property is affiliated with the nearby Grandview Baptist Church; Winkle replied the parcel is separate and “quite a bit down from the church.” Councilor Jamie Stout moved for approval and the motion passed on a roll‑call vote with all council members present voting yes.

The ordinance directs staff to update the official zoning map and includes standard repealer and severability language; the ordinance sets an effective date in its text. No conditions or special use permits were noted in the public record of the hearing.

The ordinance applies to property described in the agenda as in the Northeast Quarter of Section 11, Township 14 North, Range 18 East of the Indian Base and Meridian, Muskogee County, Oklahoma. Staff said the applicants were not present to speak but had been notified and neighbors had received mailed notices.

The council’s action was unanimous. The rezoning clears the way for the applicants to seek building permits and proceed with site work consistent with the RA district regulations and any applicable building or health standards.
