Planning commission approves three final plats, grants waivers for small family lots

The Rutherford County Regional Planning Commission approved three final plats at its March 24, 2029 meeting, granting waivers needed for newly created lots that do not meet standard lot-size or hydrant-distance requirements.
The approvals matter because each plat creates smaller lots or site conditions that required explicit waivers: two involved family divisions creating lots under five acres served by private easements, and one requested a fire-hydrant distance waiver because the local water line cannot support a hydrant.
Staff told commissioners the plats were otherwise in order. The Ruby lot (file 22520081) is a 2.8-acre lot along Independent Hill Road created from a larger tract and seeks a waiver for a lot under five acres served by a private easement. Jamie Reed represented the applicant and was present. Simmons Estates on McKee Road proposes a 1.538-acre lot; consolidated utility district documentation shows a nearby water line cannot support a hydrant, prompting the hydrant-waiver request. The Belinda Lillard subdivision proposes two lots on 7.3 acres at 5222 Old Nashville Highway and seeks a waiver because a new lot would be less than five acres and accessed by a private easement; the planning commission previously approved a related waiver in December 2024, the staff report said.
All three motions carried on roll-call votes with no recorded opposing or abstaining votes. The planning commission secretary conducted roll calls for each motion; the recorded “yes” votes for each item included Jim Aberwater, Jeff Phillips, Mike Kush, Lee Bogle, Charlotte P., Trey Gooch, Jim Thompson, Jason Beavers and Pettis Reed.
The commission removed one final-plat item, Baxter Subdivision (25-2011), from the agenda after staff said the remaining issue would be resolved by notation on the plat regarding a fire-hydrant waiver and could be handled administratively. No members of the public signed up to comment during the public-comment period.
The commission recessed to other business after the votes and staff reminded members of upcoming meetings and a Plan Rutherford work session scheduled to follow the April 28 meeting.
