County attorney authorized to sue contractors over Country Club Heights sewer and water project

Seminole County’s county attorney told commissioners on March 25 that staff seek authorization to initiate litigation against Benchmark Construction Company LLC, Liberty Mutual Insurance Company, and MG Underground LLC related to a 2022 contract for Country Club Heights sewer and water main replacement.
The county attorney said the project experienced lengthy delays and deficient work; the board voted in November 2024 to terminate the contract. County staff and the county attorney's office have been working with the surety company and contractors to resolve the issues under the performance bond but reported little progress and recommended litigation to protect the county’s interests.
A commissioner moved and seconded a motion to authorize litigation; commissioners voted in favor by voice, and the county attorney announced they had direction to proceed. The county attorney did not provide a dollar figure for claimed damages during the public report; staff will proceed with litigation steps and report back as necessary.
The authorization directs the county attorney’s office to file suit against the named contractors and the surety to recover costs and complete the project or enforce performance bond rights, per county counsel’s presentation.
