Seminole County commissioners on March 25 adopted a resolution vacating an unnamed, unimproved 15‑foot alley in the Lockhart subdivision, uniting platted parcels near 2415 West Eighteenth Street into single ownership.
Caitlin Apgar, planner with Seminole County Planning and Development Services, told the board the alleyway was platted in 1924 and runs between 2415 West Eighteenth Street and a portion of Lot 9, Block 1 of Lockhart Subdivision. Apgar said the unconstructed alley measures about 15 feet wide, 85.6567 feet on one side and 115.17 feet on the other, for a total area of approximately 1,506.27 square feet. She said the request resulted from a code violation dated June 27, 2024, tied to gate structures and an air‑conditioning pad in the alley, and that the applicant had provided letters of no objection from applicable utility companies; Public Works raised no objection.
The application, filed by property owner Kevin Merrilat, seeks to unite the vacated strip with adjoining lots the applicant owns. Apgar told the commission the request complies with the requirements for vacating a right of way under section 35.184 of the Seminole County Land Development Code and cited Florida Statute 336.09 as the enabling authority.
After staff presentation, Merrilat addressed the board and said he had not known the alley existed despite living at 2415 West Eighteenth Street for roughly 25 years and that he wanted the parcels joined into a single property.
Commissioner Hur moved to adopt the resolution vacating and abandoning the unnamed, unimproved portion of public right of way in the Lockhart subdivision as recorded in plat book 3, page 70; the motion was seconded and the commission carried the resolution (commissioners voiced assent and the chair declared the motion carried unanimously). The board did not record an individual roll‑call tally on the public record during the vote.
Apgar and county staff said utilities had provided letters of no objection and Public Works had no objection. Staff noted the alley would not meet minimum county standards for roadway width if constructed.
The resolution transfers the county’s interest in the platted alley; the adopted action and associated plats will be recorded in the public records of Seminole County.
The county clerk will include the resolution and supporting materials in the official record.
