Senate unanimously approves homeowners-association governance bill

The Idaho Senate on March 24 unanimously passed House Bill 3 61, legislation that clarifies governance rules for homeowner associations (HOAs), including transition requirements from developer-controlled boards to homeowner control and limits on proxy voting.
Sponsor Senator Burr said the bill “reasonably addresses” concerns raised during the previous year’s session and prescribes a transition mechanism for developer-to-homeowner control as subdivisions are completed. The legislation also clarifies proxy voting practice by prohibiting any single individual from holding more than 50% of total votes through proxies.
Senators described the measure as straightforward and useful to residents in subdivisions where developer control or proxy battles have caused governance disputes. After brief debate the roll call showed 35 in favor and none opposed; House Bill 3 61 passed the Senate and will be sent back to the House of Representatives.
