Senate approves technical update to state public defender law

The Idaho Senate on March 24 passed Senate Bill 11 81, which updates state law governing the Idaho State Public Defender following the state’s assumption of public-defense responsibilities previously managed by counties.
Senator Lakey, sponsor of the measure, described the bill as the product of negotiations among the governor’s office, the state public defender, county officials and defense attorneys. The legislation sets transitional requirements — including a plan to move state public defender staff out of county facilities by 2029 with a required 2027 transition plan — clarifies responsibilities for transcripts and other expenditures, and updates standards for workload, independence and contract compensation based on local market rates.
The statute preserves district public defenders for judicial districts and continues reimbursement obligations for certain county-provided facilities (utilities and basic maintenance remain county responsibilities, while the state reimburses for materials and equipment). The measure also lists categories of cases covered by the state public defender (felonies, certain misdemeanors, post-conviction relief and other Sixth Amendment-type matters).
The Senate suspended rules to take up the bill immediately, and after debate the chamber used the earlier suspension roll call to pass the bill on the same vote count: 34 in favor, one absent. The title was approved and the bill will be sent to the House of Representatives for further processing.
