West Allis panel recommends 10-day suspension for license 2323

The West Allis Public Safety Committee recommended a minimum 10-day suspension of license 2323, with the suspension set to begin Feb. 12 at 9 a.m. and to end Feb. 22 at 9 a.m., City Attorney Nicholas Serwin said.

The recommendation followed the committee’s finding that “the allegations of the complaint were found to be true. The licensee admitted to those violations of the complaint, and the licensee has identified that the complaint was appropriately served,” Serwin said. The committee will forward a written recommendation to the West Allis Common Council, which Serwin said is expected to consider the matter on Feb. 11.

Serwin told the committee that the 10-day suspension is the statutory minimum penalty in this case and that the suspension would run consecutively. “The suspension will begin on Feb. 12 at 9 a.m. … so you can restart at 9 a.m. on Feb. 22,” he said. He also warned the licensee that the city uses progressive enforcement, meaning future violations could prompt stiffer penalties.

Serwin said staff will put the committee’s findings and recommendation into a written form for the Common Council. He invited the licensee to attend the council meeting; he said there may not be time for formal argument but the licensee could make a public comment before the council votes.

No formal vote on the suspension by the committee was recorded in the transcript. The committee’s action was described as a recommendation to the Common Council; the council will make the final decision.

The meeting concluded with a motion to adjourn that passed by voice vote.
