Board affirms 3-acre agricultural lot rule; administrative carve-outs need not go through subdivision review

County staffer Ryan explained the county reduced its ag minimum from 10 acres to 3 acres to reduce minor subdivisions and ease the process for agricultural families to create corner lots for dwellings. “We took Keith County from a 10 acre in ag to 3,” Ryan said. Staff and commissioners discussed how an original, monumented tract cut from a quarter section that remains above the minimum would not convert the remainder into a lot requiring subdivision review.
Commissioner Schroeder moved that the board acknowledge Ryan’s research and accept the administrative approach; Commissioner Anderson seconded. The motion passed on a roll call vote (Wartman — yes; Irvin — yes; Anderson — yes; Schroeder — yes; Crandall — yes). The board instructed staff to proceed administratively when applicants meet the stated minimum standards and to return to the comprehensive-plan rewrite if policy changes are needed.
The board and staff noted limits: creating multiple residence-bearing tracts under 10 acres from the same quarter would still trigger additional review and conditional-use processes; the accepted approach applies only where the minimums are met and no additional density is being created.
