Plan Commission approves acquisition of small parcel at 420 N. Main to resolve parking encroachment

The Oshkosh City Plan Commission on Feb. 19 approved the acquisition of a small triangular parcel (approximately 153 square feet) at the southwest corner of 420 North Main Street to resolve a parking-lot encroachment onto private property adjacent to a city-owned parking lot.
City staff said the parcel, a 15-foot-wide by 20-foot-deep triangle, was needed because a portion of the 400 block west parking lot encroached onto private property. In late 2023 the parking lot was resurfaced and staff identified property issues; most were addressed by vacations and land swaps, with this acquisition the last step before preparing a certified survey map for the lot consolidation. The city approached the property owner, Rebecca Croft of Escape Rentals LLC, who agreed to transfer the small area; the city attorney drafted a quitclaim deed the owner signed.
Staff said the deed includes a 20-year reverter clause that allows the owner to demand reacquisition if the city sells the property or ceases to use it as a public parking lot within 20 years of recording. When asked whether the owner received compensation, staff said she did not. Public Works and legal staff recommended approval; the commission adopted the findings and recommendations 6-0.
