Council members and members of the public debated whether the draft ordinance, which would add Chapter 2-83 to the town code and limit private uses of the town seal, was clear enough about permitted exceptions and whether it could face First Amendment challenges. Supporters said restricting the seal would help residents identify official communications and reduce fraud, while several council members urged more precise definitions of "official business" and permitted uses for volunteers, appointed boards and school-related groups.
The ordinance was introduced as sponsored by Council members Iannotti and Tapie. Council members asked for explicit language allowing routine uses—such as town council newsletters, parade materials, or National Honor Society activities—so citizens and volunteers would know when use is permitted. Councilwoman Taaffe moved to continue the public hearing; the motion was seconded and the council voted in favor.
Solicitor Colon said he did not, "as drafted at this point," see a constitutional problem but said he would review recent cases and advise the council. Council members referenced a pending matter in East Greenwich and requested the solicitor return with a legal opinion and suggested ordinance edits including a definitions section, a list of permitted and prohibited uses, and clearer enforcement language. Residents who spoke urged inclusion of appointed board members and committee uses in any permitted exceptions.
The council left the hearing open and set the continuation for the council's second February meeting (Feb. 18, 2025). The council instructed staff and the solicitor to draft clarifying language and to return with recommended amendments and legal analysis before a final vote.
The public hearing will remain open for additional comment at the Feb. 18 meeting.
