North Kingstown council approves multiple settlements, permits and appointments; reconsideration of electricity aggregation fails

The North Kingstown Town Council on Feb. 24 voted on a package of procedural and substantive items including sealing executive-session minutes, approving several consent items, settling tax appeals, endorsing Conservation Commission recommendations for two CRMC filings, and approving multiple municipal appointments.

The council voted to go into executive session "pursuant to General Laws 40-2-46-4 and 5, subsection 2" for litigation and tax appeals and later voted to seal the executive-session minutes. The consent calendar (items 6, 9 and 11 through 13) was approved in a single motion, and several individual calendar items were moved and approved separately.

The council approved a sewer assessment settlement for Rear Land LLC, authorizing a revised assessment and abating $122,000 in late fees; the town manager explained the settlement reflects negotiation to avoid protracted litigation. The council also approved tax-appeal settlement resolutions discussed in executive session, including a multi-year settlement pattern used with Stop & Shop appeals and a settlement for the Scalabrini property (North Kodeset Road) at a settled assessment of $5,700,000 (the town previously assessed the parcel at $6,200,000 and the 2021 purchase price was $4,000,000).

On land-use filings, the council agreed to file "no substantive objection" recommendations to the Coastal Resources Management Council (CRMC) for two condominium/adaptive-reuse projects (the Wakefield schoolhouse and the old theater), incorporating the Conservation Commission's recommendations.

A motion to reconsider the town's recently approved electricity supply agreement for the municipal community aggregation program failed for lack of a second after Councilor Hill Ross announced she wanted to change her earlier vote from yes to no. Council members discussed the procedural steps required for reconsideration and declined to proceed without a second.

The council also approved a request to ask the Rhode Island Department of Transportation to study noise mitigation along Route 403, approved a change to an exhibition license date for Brookford Village Association (from June 19 to June 20), and confirmed a range of board and commission appointments and reappointments, including reappointing Peter Morgan as tree warden and appointing Captain John McCoy as the town appraiser of dog damages through April 1, 2026.
