The North Smithfield Zoning Board of Review continued an appeal for 44 Railroad Street to Feb. 25, 2025, after the appellant requested additional time to consult with town zoning staff.
A letter dated Jan. 23, 2025, from Mancini and Carter, Attorneys at Law, representing A and M Transport, asked the board to continue the hearing to allow the applicant’s engineers to meet with the town zoning department to address information the board requested at an earlier meeting. The letter was accepted into the administrative record as exhibit P13.
Board members discussed scheduling constraints and staff availability before taking the motion. A board member moved to accept the continuance to Feb. 25; another member seconded. Members voted in favor by voice (“Aye”); the chair announced the continuance to the next available date, Feb. 25, 2025.
A board member noted the applicant’s counsel had indicated the engineer wished to “sit down with the zoning official to discuss and/or to understand” the additional information requested by the board. The board observed that several items previously requested from the applicant had not been provided to staff and that the hearing could be complex.
The continuance was recorded without further conditions in the meeting minutes. The board instructed staff to place the matter on the Feb. 25 agenda and to distribute any materials received from the applicant to board members prior to the next hearing.
