Council awards $401,470 tree-removal contract for Case Creek Estates sidewalks after heated debate

Layton City Council voted on March 20 to award a professional-services contract to Paige's Professional Tree Service to remove trees and grind stumps as part of a sidewalk repair project in the Case Creek Estates subdivision.
Staff presented bids from three firms and recommended Paige's, saying the company had the capacity, equipment and insurance needed for the larger job. Paige's submitted the lowest responsive and responsible bid at $401,470, though staff noted optional trees and homeowner removals will reduce the final total.
The item drew prolonged public comment and council deliberation. Residents said they wanted the option to repair sidewalks themselves or hire lower‑priced contractors; staff and several council members responded that sidewalk permits would require tree removal in any case because trees causing vertical separation leave the city liable for future trip hazards and Americans with Disabilities Act (ADA) compliance. City staff also said timing and contractor availability mean delaying the contract would almost certainly raise prices and could leave an ongoing public‑safety liability.
Councilmembers discussed alternatives including getting more bids, offering additional time for homeowners to remove trees themselves, or the city covering more of the cost. After debate, Councilmember Roberts said he could not support awarding the contract under the current terms and voted no. Four other councilmembers voted to award the contract, 4–1.
Resolution 25-18 authorizes the city manager to execute the agreement for the Case Creek Estate sidewalk repair project. Staff will return with a final contract reflecting homeowner decisions about optional trees and a construction schedule. Staff also said the city will enforce requirements that stump grinding and root removal meet the city’s standards so future sidewalk settling is minimized.
