The Board of Zoning Appeals approved a variance permitting the installation of a private swimming pool at 2795 Coffee Court during its March 2025 meeting, board officials said. The board voted 7-0 to grant the request after hearing a staff report and remarks from the applicant.
City staff told the board the lot at the terminus of Copley Court is pie-shaped and constrained by a 35-foot building line, multiple side property easements and stormwater-management easements. A staff member said the applicant asked for two variances: to place the pool in a side yard and to reduce a diagonal utility easement encroachment. “Staff recommends approval with the 4 conditions as shown,” the staff member said.
Staff explained that the lot’s shape and the location of platted easements left limited buildable area, and that the proposed pool location would have “minimal impact on the surrounding area, including the adjacent properties.” A board member asked about measured distances; the staff member said that the pool pavers would be as close as 8 feet 6 inches from the side property line in the proposed plan, noting that the relevant reduction would be “from 10 to 8 foot 6.”
Applicant Jeff Bay, who identified himself as residing at 2795 Coffee Court, told the board his mortgage survey shows an 8-foot easement at the left side of the property and said the planned surface around the pool would be pavers rather than permanent pavement. “The easement on that left side of the property, it's only an 8 foot easement. Not a 10 foot easement,” Bay said. He added the pavers could be removed if utility work were required.
Staff told the board it recommended shifting the pool slightly to the south so digging for the pool would remain outside the diagonal utility easement that crosses the yard. The staff member also said the property owner would be responsible for replacing any pavement or pavers if utility companies subsequently cut into the surface to access lines.
The record shows notices were mailed to properties within 200 feet of the site and staff reported no responses from neighbors. After discussion, the board approved the variances subject to the four conditions recommended by staff.
