Council requires any material curbside contract changes return for approval after program launch

The Portsmouth Town Council voted unanimously Feb. 10 to require that any material changes to the curbside waste solicitation or subsequent contract must be returned to the council for review and approval.

Councilors debated whether involving the council in post‑award contract modifications would unduly interfere with administration. Town Administrator Rayner and the town solicitor said routine management adjustments are the administrator’s purview, but council members argued that changes to legally significant contract terms — for example, pricing, barrel sizes or contractor‑supplied equipment — should come back to the council.

Councilor McDowell said she was concerned that parts of the solicitation language (cited in the meeting as sections such as C.6) no longer matched expected operations and should be corrected with council approval; other councilors urged deference to management where changes are minor. The council settled on a compromise: material changes to the executed contract must be documented and returned to the council for approval. The motion passed 6 to 0.

The town had launched the curbside program earlier in Rayner’s report the same evening and opened the sign‑up period; staff said carts have been ordered and that a 96‑gallon cart size had been adopted per council direction.

Town staff said the signed contract exists and that any addenda or changes that meet the council’s materiality standard will be routed back for formal council action.
